I'm not sure about the latter, but after the 5/3 episode, I'm convinced of the former. He told Cooper and Truman that he followed a red corvette to the Old Sawmill Road, and then lost it. He was probably nosing around looking for it when he saw James and Donna bury the necklace, and dug it up afterwards.
