He obviously had a rather severe bullet wound to the brain, but remember that as Jeffery is entering the room and sees him, the guy's walkie-talkie blurts out a message and we see the man's arm flail out. This would indicate some kind of neurological activity still being present. When Frank returns to the apartment later, he fells him for good with another shot.
